This Privacy Policy explains the information that Smooch Labs, Inc. collects about users of the JSwipe mobile application and related website (jswipeapp.com) how we use that information, and with whom we share it. If we make any material changes to our privacy practices, we will post a revised Privacy Policy on this page. As used in this policy, the terms "JSwipe," "us," "we," "our," and "ourselves" refer to Smooch Labs, Inc. ("the Company" that created JSwipe). The terms "you," "your," and "yourself" refer to users of our Service.

1. Information We Collect

Personal Information

In the course of your use of the Service, we may collect individually identifiable information that would allow us to determine the actual identity of, and contact, a specific living person (“Personal Information”). Such Personal Information may include information comments or content that you provide to the Service that may reveal your nationality, religion, ethnic origin, and/or sexual orientation. By providing such Personal Information to us, you consent to the collection, use and disclosure of such Personal Information in accordance with this Privacy Policy and applicable laws.

Registration (Facebook Login)

In order to register, you will be asked to sign in with your Facebook account. In doing so, you authorize us to collect relevant information necessary to enable JSwipe to access Facebook, and Facebook will provide us with access to certain information that you have provided to it. By allowing us to access your Facebook account, you understand that we will obtain and share your information, as well as the name and profile picture of your Facebook friends who are common Facebook friends with other JSwipe users in your network or geolocation. We will use, store, and disclose such information in accordance with this Privacy Policy. However, please remember that the manner in which Facebook uses, stores, and discloses information is governed by its policies, and JSwipe shall have no liability or responsibility for its privacy practices or other actions.

Voluntary Personal Information

Whenever you voluntarily disclose personal information on publicly-viewable screens or pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information. If you wish, we will delete your account information; to do so, please close your account by sending an email to [email protected]

Information about Others

We may collect and store personal information about other people that is available to us through your Facebook login, namely the name and picture of certain of your Facebook friends as follows: we will only share this information with other JSwipe users who are already friends with your Facebook friend and who already have access to such information.


JSwipe is a location based mobile dating application that helps you find Jewish singles nearby. While the JSwipe application is in use, we keep track of your location information (e.g. by using the GPS on your mobile device), to provide the functionality of our service. Please keep in mind that other JSwipe users can see this information about you, and they may use it or disclose it to other individuals or entities outside of our control, and without our knowledge. Your information may be subject to abuse, misuse, or monitoring by others, and you share this information at your own risk. Unless you turn off your location services, we will collect your location information, and by using our service, you consent to our collection, storage, and analysis of your location data.

Information from Other Sources

JSwipe is owned by Spark Neworks, Inc., which owns a portfolio of dating websites and applications, including, without limitation, JDate and Faith.com. We may obtain both personal and non-personal information about you from other Spark Networks, Inc. businesses.

Technological Collection; Cookies and Device IDs

We use various technologies to collect information from your device and about your activities on our Service. We automatically collect information from your browser or device when you visit our Service. This information could include your IP address, device ID and type, your browser type and language, the operating system used by your device, access times, your mobile device’s geographic location while our application is actively running, and the referring website address. When you access the Service, we may send one or more cookies and small text files containing a string of alphanumeric characters to your computer or device. JSwipe may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Service. Persistent cookies can be removed. Please review your web browser 'Help' file to learn the proper way to modify your cookie settings. JSwipe does not respond to “Do Not Track” signals. In order to recognize you, store your preferences, and track your use of our application, we may store your mobile device IDs (the unique identifier assigned to a device by the manufacturer) when you use the JSwipe application. Unlike cookies, device IDs cannot be deleted.

Additional Information

When you use our Service, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. JSwipe may store such information itself or such information may be included in databases owned and maintained by JSwipe affiliates, agents or service providers. This Service may use such information and pool it with other information to track, for example, the total number of users of our services, or analyzing trends in downloads, invites, or messaging, for instance. JSwipe may occasionally conduct research on customer demographics by aggregating individual data of our users. JSwipe may share this non-identifiable and aggregate data with its affiliates, agents, and business partners, but this type of aggregated data does not identify you personally.

2. How We Use Your Information

We use the information we collect about you in a manner that is consistent with this Privacy Policy. For instance, we use your information:

to connect you with Jewish singles nearby;

to monitor your use of the service in order to improve your user experience;

to respond to your comments and inquiries;

to inform you by email, phone, social media, or mobile device of any promotional offers either from us or from other third parties;

for any other purpose for which the information was provided.

When you register as a user of JSwipe, your JSwipe profile will be viewable by other users of the Service.

3. Use Of Your Information By Others

Use of Personal Information

JSwipe cares deeply about your privacy and without your prior consent, we will not share your Personal Information except as outlined in this Privacy Policy. With that said, there may be circumstances that may lead us to share your Personal Information to a third party without further notice to you. For example, we may share information, including Personal Information, without notice, with third parties that perform certain services on our behalf. These services may include fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, ad tracking and analytics, member screenings, supporting our Service functionality, and supporting contests, sweepstakes, surveys and other features offered through our Service. In addition, we may share your Personal Information without notice with certain third parties that offer services that are supportive of or related to the Jewish community, including, without limitation, Jewish Charitable organizations. If you are a California resident, you have the right to request additional information about this sharing, so please see Section 9 below for more information. Additionally, we may share your information, including Personal Information, in the event of a corporate sale, merger, reorganization, dissolution or similar event; with our corporate affiliates or subsidiaries for purposes consistent with this Privacy Policy; to enforce our Privacy Policy or other terms of service; and if required to do so by law or when we believe in good faith that such disclosures are required by law; to protect and defend the rights or property of JSwipe, protect the personal safety of users of the site or the public, or protect against legal liability.

Use of Aggregate or Non-Personal Information

We may use and share non-personal information we collect under any of the above circumstances. We may also share it with other Spark Networks, Inc. companies and third parties to develop and deliver targeted advertising on our Service and on websites or applications of third parties, and to analyze and report on advertising you see. We may combine non-personal information we collect with additional non-personal information collected from other sources. We also may share aggregated, non-personal information, or personal information in hashed, non-human readable form, with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis, advertising, marketing, or other business purposes.

4. Children's Privacy

We do not allow persons under 18 to register for any service, and we do not knowingly collect any personally identifiable information from persons under the age of 18. If you are under 18 years of age, please do not use our Services and please do not submit any personal information through our Services. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing children under the age of 18 never to use our Services. Please contact us immediately if you have reason to believe that a child under the age of 18 has provided personal information to JSwipe, and we will make every attempt to delete that information from our databases.

5. Information From Users Outside The United States

If you're outside the United States, your information will be sent to and stored in the United States, where our servers are located. By using JSwipe, you agree to the information collection, use, and sharing practices described in this Privacy Policy. If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your personal data, including sensitive data, by JSwipe from your region to countries which do not have data protection laws that provide the same level of protection that exists in countries in the European Economic Area, including the United States. By providing your personal information, you consent to any transfer and processing in accordance with this Policy.

We provide areas on our Service where you can post information about yourself and others and communicate with others. Such postings are governed by our Terms of Service [insert link]. This Service may contain links to other websites or services not operated or controlled by JSwipe. The policies and procedures we describe here do not apply to these third party sites, nor do the links from this Service imply that JSwipe endorses or has reviewed these third party sites. We suggest contacting those sites directly for information on their privacy policies.

8. Steps We Take To Protect Your Privacy

JSwipe takes reasonable steps to protect the Personal Information provided via the Service from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet, email or other electronic transmission is ever fully secure or error free, so you should take special care in deciding what information you send to us in this way.

9. California Privacy Rights

We may elect to share information about you with certain third parties that offer services that are supportive of or related to the Jewish community for those third parties’ direct marketing purposes. California Civil Code § 1798.83 permits California residents who have supplied personal information (as defined in the law) to us to, under certain circumstances, request and obtain certain information regarding our disclosure, if any, of personal information to third parties for their direct marketing purposes. If this law applies to you, you may obtain the categories of personal information shared by us and the names and addresses of all third parties that received personal information for their direct marketing purposes from us during the immediately prior calendar year (e.g., requests made in 2019 will receive information about 2018 sharing activities). To make such a request, please provide sufficient information for us to determine if this applies to you, attest to the fact that you are a California resident and provide a current California address for our response. For all requests, please clearly state that the request is related to “Your California Privacy Rights”, include your name, street address, city, state, zip code and e-mail address (your street address is optional if you wish to receive a response to your request via email) and indicate your preference on how our response to your request should be sent (email or postal mail). We will not accept requests via the telephone or by facsimile. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

10. Changes To Our Privacy Policy

Although most changes are likely to be minor, JSwipe may change its Privacy Policy from time to time. When we do, we will let you know by changing the "Last Updated" date within this Privacy Policy, and your continued use of the Service shall indicate your agreement with the terms of the revised Privacy Policy.
